Classic Marques Standard Terms of
Agreement and Conditions of Sale
BASIS OF CONTRACT
An order from a customer shall constitute an offer.
An invoice, written or verbal
confirmation of order from Classic Marques constitutes an acceptance.
In the case of a telephone sale the
taking of credit card details or Paypal by Classic Marques constitutes an
acceptance.
All contracts are subject to these
written terms. Variations to the terms or representations regarding the
goods are not binding unless confirmed in writing by Classic Marques
The price of the goods shall be the
Classic Marques retail price which may differ from the published price. The
customer should check with us direct.
The price is exclusive of VAT
which will be added.
An order accepted as above cannot be
cancelled by the customer.
PAYMENT
Customers who do not have an agreed credit account must make payment in
advance, with the order.
Payment is to be by cash, Access,
Visa, Mastercard, Connect, Switch, banker’s draft, Paypal or other
guaranteed funds. We reserve the right not to dispatch goods until payments
have been cleared.
DELIVERY
Delivery charges will be shown on the invoice.
Any dates quoted for delivery of
goods are approximate only and not a term of the contract
RETURNS (Parts)
Goods are not supplied on a sale or return basis.
Returns will only be accepted if
previously agreed in writing.
Where the part ordered by the
customer is supplied, but not the one which the customer really requires,
then we may agree to exchange it but there will be a handling charge of 15%
of the price of the replacement goods.
we will waive the handling charge
where the replacement goods are of the same or greater price than the
returned goods and where the returned goods are received back intact and
undamaged.
Any other returns will be stored at
the customer’s expense.
Replacement goods (parts) must be
paid for in advance as set out in Under the distance selling regulations,
you have the right to cancel your order for any item purchased on this
website (except cars) within 7 working days starting from the day after
delivery.
We will issue you a full refund
(excluding carriage charges) within 30 days of the date of cancellation.
This does not apply to items personalised or made to your specification.
(for example seat covers and trim “made to order”) To cancel, you can e mail
us (use “contact” page) or write to us within 7 days of delivery of your
item(s) quoting your order or invoice number.
You must take all reasonable care of
the item(s) and must not have used or fitted them. The item(s) may then be
returned to us, must be securely packaged, and sent to our address (see
below). PLEASE NOTE: you are responsible for the cost of returning the goods
to us (unless they were delivered to you in error or the goods are faulty).
After 7 working days then surcharges will apply.
Non Refundable Deposits on
Vehicles.
We pride ourselves on 100% accurate
descriptions and have sold many vehicles all over the UK, Europe and
Worldwide.
We insist on potential customers
viewing vehicles directly themselves or getting vehicles properly inspected
by the trade, the AA or RAC prior to purchase.
A deposit is non refundable
and a commitment to purchase, If you decide not to purchase a car
then the deposit will only cover some of the costs incurred with any
sale (time, re-advertising, servicing, valeting etc)
TITLE TO THE GOODS (parts)
Risk passes to the customer on delivery.
Title only passes to the customer on
payment.
LIABILITY
Classic Marques are not liable for the consequences of incorrect fitting or
use of goods supplied.
Classic Marques are not liable to
the customer by reason of any delay or failure to perform arising from
circumstances beyond their control
Classic Marques are not liable for
problems for damages arising from failure by the customer to supply full or
correct information or LOST IN TRANSIT
If the customer’s goods do not arrive within a reasonable time, the customer
should report to Classic Marques who reserve the right to investigate before
despatching replacement parts.
Urgently required parts despatched
before investigations are complete must be paid for in addition by the
customer.
The customer will be reimbursed
where Classic Marques succeed in settling loss with the carriers or third
parties.
GENERAL
9.1 There should be no alteration in these terms and conditions save as
confirmed in writing by Classic Marques.
If any of these terms and conditions
is or becomes invalid, illegal or unenforceable in law, the remaining
conditions shall not be affected.
The law applicable to the Agreement
is the law in England and Wales and the customer will submit to the
jurisdiction of the English and Welsh courts.

REGISTERED. ALL PRICES QUOTED DO NOT INCLUDE VAT.
